VOLUNTAINER Overseas Membership Regulations
- Article 1 (General Provisions)

- These Tokyo Marathon Foundation Official Volunteer Club VOLUNTAINER Overseas Membership Regulations (hereinafter, the "Regulations") set forth the terms of use for the membership services (hereinafter, the "Services") provided to members who have registered an address outside of Japan at the time of membership registration (hereinafter, the "Overseas Members") among the members (hereinafter, the "Members") who have been registered with the official website (hereinafter, the "Website") of the Tokyo Marathon Foundation Official Volunteer Club VOLUNTAINER (hereinafter, "VOLUNTAINER"), which is operated by the Tokyo Marathon Foundation (hereinafter, the "Foundation").
- The Services fall under the standard transaction as defined in Article 548-2, paragraph (1) of the Civil Code, and the Regulations fall under the standard terms and conditions as defined in the same paragraph.
- The Regulations shall apply to the Overseas Members regardless of their nationality. The Members who have registered an address within Japan shall not be subject to the Regulations regardless of their nationality, and shall be subject to the Tokyo Marathon Foundation Official Volunteer Club VOLUNTAINER Membership Regulations.
- The Overseas Members are not eligible for the following services:
- VOLUNTAINER Points Program
- VOLUNTAINER Leader/Leader Support Registration
- VOLUNTAINER COMMUNITY and BBS
- Team Entry
- Junior Entry
- Article 2 (Purpose of VOLUNTAINER)

The Foundation operates VOLUNTAINER with the following purposes:
- Increase the volunteer participation rate and promote continuous volunteer activities.
- Create an enjoyable and easy to be active environment and provide useful information for activities.
- Article 3 (Regulations and Services)

- Only those who agree to the Regulations and complete the membership registration process shall become the Members and be eligible to receive the Services.
- The Services include the following:
- Entry through the Website to the Tokyo Marathon and other events or skill-up training programs (hereinafter, the "Events") for which the Foundation recruits volunteers.
- Management of the participation history of the Events on the Members' personal page on the Website (hereinafter, "My Page"), and the issuance of volunteer activity certificates (Activity certificates can be issued only for eligible events. For up to five years from the date of the Events, activity certificates can be issued retroactively only if participation in events is confirmed. However, the certificates shall not be issued if more than five years have passed since the event date.)
- Provision of information regarding volunteer opportunities at the Tokyo Marathon and other events via email newsletters, etc.
- Other services provided by the Foundation on the Website.
- Article 4 (Amendment of Regulations)

The Foundation may, at its discretion, add, delete, modify, or otherwise change the Regulations and the Entry Regulations, the Participation Regulations, Application Guidelines of the Events, Privacy Policy and other associated regulations (hereinafter collectively, the "Associated Regulations") in the following cases:
1)When the amendment to the Associated Regulations coincides with the general interest of the Members.
2)When the amendment to the Associated Regulations does not contradict the purpose of the contract and is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, the content of the amendment, and other circumstances related to the amendment.
If the Associated Regulations are amended according to the preceding paragraph, the Foundation shall notify the Members of the amendment, the amended provisions, and the effective date of the amendment on the Website, or by other appropriate means. The amended Associated Regulations shall become effective from the effective date stated above. The amended Associated Regulations shall apply to the Members who have used the Services after the effective date of the amendment to the Associated Regulations.
- Article 5 (Membership Registration)

- For the purpose of the Regulations, the Members refer to those who have agreed to the Regulations, registered as a VOLUNTAINER on the Website with the Foundation, and whose registrations have been approved by the Foundation.
- Those who are registered as VOLUNTAINERs must meet all of the following conditions:
- Must agree to the Regulations and the Associated Regulations;
- Must be individuals of elementary school age (6 years old) or older;
- Must not be members who have already applied for or registered for the Services;
- Must not have any purpose other than personal use (such as commercial purposes);
- Must not have had their membership revoked or been expelled by the Foundation in the past and The registration applications must not contain any false statements, errors, or omissions.
- When the Foundation accepts registration applications, it shall notify the applicants of the registration approval via email or other means, and such notification shall enable the applicants to use the Services. If it is discovered after the commencement of use of the Services that the Member does not meet any of the conditions in the preceding paragraph, the Foundation may revoke the membership of the relevant Member.
- The Members will be assigned a VOLUNTAINER IDs (Plus member IDs) by the Foundation.
- Article 6 (Membership Fees, etc.)

No membership fees will be required to register as a VOLUNTAINER.
- Article 7 (Use of Services)

The Members shall agree to the provisions of the Entry Regulations and the Application Guidelines when entering the Events through the Services, and to the provisions of the Participation Regulations and the Application Guidelines when actually participating in the Events, and shall comply with all the Associated Regulations.
- Article 8 (Interruption and Suspension of Services)

- The Foundation may interrupt or suspend the provision of the Services if any of the following cases:
- Interruption or suspension is unavoidable due to maintenance, inspection or construction of equipment necessary for providing the Services;
- Telecommunications services provided by a telecommunications carrier are interrupted or suspended for any reason;
- The Foundation considers it necessary to interrupt or suspend the Services for operational or technical reasons or Otherwise, the interruption or suspension of the Services is unavoidable.
- In the event of interruption or suspension of the Services as stipulated in the preceding paragraph, the Foundation shall notify the Members in advance of the date, time, duration, and other information to the extent possible. However, this does not apply if advance notice is hindered by reasonable reasons.
- The Foundation shall not be liable for any damages incurred by the Members as a result of any interruption or suspension of the Services by the Foundation.
- Article 9 (Notification from the Foundation)

- The Foundation shall notify the Members of any necessary information (hereinafter, the "Notification") from time to time by posting it on the Website.
- The Foundation shall notify the Members via email when the Notification is posted on the Website.
- Article 10 (Obligations of Members)

- The Members shall comply with the provisions of the Regulations and the Associated Regulations as well as any other matters notified by the Foundation, and shall not engage in any conduct that interferes with the activities or operations of the Foundation.
- The Members shall be responsible for properly managing their VOLUNTAINER IDs (Plus member IDs)
and passwords. If a Member becomes aware that their VOLUNTAINER ID (Plus member ID) or password has been or is likely to be used improperly, the Member must immediately notify the Foundation to that effect. If the Foundation or a third party suffers damage due to the unauthorized use of the relevant VOLUNTAINER ID (Plus Member ID) or password, the Member shall be solely responsible for compensating for such damage, and even if the Member or a third party suffers damage, the Foundation shall not be held liable in any way.
- The Members are prohibited from conducting any of the following:
- Any act of violating the Regulations and the Associated Regulations;
- Any act of interfering with the operation of the Services;
- Any act of violating laws and regulations or public order and morals;
- Any criminal act, or any act that aids or pertains to criminal acts, or any act that is likely to do so;
- Any act of transmitting large amounts of information with the intent of disrupting the stable operation of the Services;
- Any act of distributing computer virus programs that trigger malfunctions in information and telecommunication equipment or the destruction of information;
- Any act of registering as the Members by impersonating someone else, or any act of illegally logging into the Website with another person's VOLUNTAINER ID (Plus member ID) or password;
- Any act of infringing on the intellectual property rights, including copyrights, trademark rights, and patent rights, held by the Foundation or a third party;
- Any act that damages or is likely to damage the credence or reputation of the Foundation, other Members, or third parties, or any act that infringes or is likely to infringe upon the privacy, portrait rights, or other rights of third parties;
- Any act of posting sexual, violent, or discriminatory content that is deemed inappropriate by the Foundation, or any act of posting links to websites that contain such sexual, violent, or discriminatory content;
- Any act of acquiring, using, selling, etc., the VOLUNTAINER logo, or any goods or information obtained through the Services or activities entered through the Services for commercial purposes or in any other manner not authorized by the Foundation;
- Missionary and soliciting activities by religious organizations, or propaganda activities by political organizations;
- Any other acts that are deemed by the Foundation inappropriate for the Members of VOLUNTAINER based on reasonable grounds.
- The Members shall promptly register any changes to their registered information. The Foundation shall not be held liable for any damages incurred by the Members due to the failure to register changes.
- Article 11 (Compensation for Damages)

The Members shall be responsible for compensating the Foundation or any other third party for any damages caused by reasons attributable to the Members while using the Services.
- Article 12 (Prohibition of Transfer)

The Members may not transfer, donate, or lend the Services and other status under the Regulations to any third party, whether with or without consideration. Furthermore, the Members may not provide the Services and other status under the Regulations as collateral.
- Article 13 (Disclaimer)

- The Members shall use the Services at their own risk in accordance with the Regulations and the Associated Regulations. The Foundation shall assume no responsibility whatsoever for any damages resulting from information, materials, etc., obtained by the Members through the use of the Services. The Foundation shall also assume no responsibility whatsoever for the reliability, accuracy, or recency of any information, materials, or facts provided in the Services.
- The Foundation shall not be liable for any disruption to the use of the Services caused by reasons not attributable to the Foundation.
- The Foundation shall not be held liable for any inability to provide the Services in the event that such inability is caused by natural disasters, statutory measures, administrative guidance, guidance from supervisory authorities, incidents or accidents, outbreaks of infectious diseases, or other force majeure events.
- The Foundation shall not be liable for any damages incurred by the Members, including, but not limited to, inaccessibility to all or part of the Services due to the malfunctions of computers or other telecommunications terminals, communication services, and network environments used by the Members.
- In the event that the Events are canceled or scaled down due to weather conditions on the day, natural disasters, incidents, errorist attack, warning of terrorist attack, strikes, riots, traffic conditions on roads, rail,air, etc., legal orders, administrative measures, or any other unavoidable circumstances, the Foundation shall assume no liability.
- Article 14 (Withdrawal from Membership)

- The Members shall withdraw from VOLUNTAINER in the following cases:
- If a Member fails to fulfill their obligations as stipulated in Article 10, and the Foundation terminates the Member's membership;
- If a Member submits a notification of withdrawal to the Foundation in the prescribed method and the notification is received;
- If a Member dies;

If a Member engages in any of the prohibited acts set forth in the Regulations or the Associated Regulations, and fails to comply with any notice from the Foundation.
*Personal information linked to the Members will continue to be held by Fanplus, Inc., which is entrusted with the management and operation of VOLUNTAINER's official website.

- Any Member shall be withdrawn from membership at the time the reason for withdrawal described in the preceding paragraph occurs. If the Member has entered the Events at the time of submitting the notification of withdrawal, the entry to the Events shall be canceled at the time of withdrawal.
- Sending materials to the Members who have withdrawn from membership shall cease from the time of withdrawal.
- Membership is personal and shall not be inherited.
- Article 15 (Personal Information)

The Foundation shall handle personal information obtained from the Members in accordance with the Privacy Policy separately stipulated. By agreeing to the Regulations, the Members shall be deemed to acknowledge that their personal information will be handled as described in the Privacy Policy.
- Article 16 (Intellectual Property Rights)

All copyrights and other intellectual property rights in and to the content, layout, designs, and structure posted on the Website shall belong to the Foundation.
Please note that unauthorized reprinting, reproduction, or quotation of the content posted on the Website constitutes an infringement of the intellectual property rights of the Foundation.
- Article 17 (Matters for Consultation)

Any matter not stipulated in the Regulations and the Associated Regulations or any doubt as to the interpretation of the Regulations and the Associated Regulations shall be resolved through good-faith consultation between the Members and the Foundation.
- Article 18 (Agreed Exclusive Jurisdiction)

In the event that any dispute arises between the Foundation and the Members regarding the Regulations or the Associated Regulations and needs a litigation, the Foundation and the Members shall agree that the Tokyo District Court is the exclusive court of first instance with agreed jurisdiction.
- Article 19 (Governing Law)

The Regulations and the Associated Regulations shall be governed by the laws of Japan.

Entry Regulations

- Those who intend to enter the Events must be registered members of VOLUNTAINER.
- If the number of entries for the Events recruiting volunteers exceeds the number of the required volunteers, participants shall be selected in a drawing.
- If the Members use multiple IDs to enter the Events on the same day, all of their entries for that day shall be invalidated when such duplicate entries are found out.
- Entries shall only be accepted through the entry form on the Website. Entries shall not be accepted by telephone or email.
- Age restrictions are established for each event. If elementary and junior high school students enter the Events, they must make a group entry with their parents or guardians. (Click here for details.)
If minors are entered to be a volunteer, consent from their parents or guardians shall be required.
- Depending on the device, operating system, and browser software, the Members may not be able to enter the Events. Entry with cellular phones (feature phones) cannot be made.
- Even if the Members suffer any damage as a result of being unable to enter or of delay in entry due to non-compliant device, or malfunctions with internet connection or email system, the Foundation shall not be held liable for such damage.
- The Members cannot make inquiries or request for information regarding entry status or drawing results via telephone or email. The Members should check the details of entry and the drawing results described on My Page on the Website. Please note that some entries may not be recorded on My Page.
- If the Members wish to cancel their entry or change the entry details, the Members must do so through My Page on the Website.
- Invitation for participation to the Events that the Members have entered will be posted on My Page or sent by email in advance. The Members should be sure to check it.
- If the Members participate in the Events as a runner, they cannot make an entry for volunteers on that day.
- If the Members participate in the Events that they have entered, they should review and comply with the Participation Regulations and the Application Guidelines set out separately.
- If the Members plan to participate in the Events using online tools, they should prepare the necessary equipment in advance, including personal computers, internet connection, cameras, and microphones. Any expenses incurred for participating such event shall be borne by the participant.
- The Foundation cannot be held responsible for any troubles that may arise in relation to the setup of internet connections, the introduction of online tools, or the preparation of necessary equipment such as cameras and microphones.
- The Members should also comply with the entry requirements and precautions established for each event.

Participation Regulations
When the Members participate in volunteer activities (hereinafter, the "Activities") or in information session, training session, etc. (hereinafter together with events in which the Activities are conducted collectively, the "Events") at the Events they have entered, the Members shall participate in the Events in accordance with the following terms and conditions.
- The Members must not be late for or leave early information sessions, registration, the Events.
- The Members who have entered the Events must attend the information session, reception and the Events in person. Participation by a substitute or change to the participant shall not be permitted.
- Identity verification will be conducted at the information sessions, reception, and the Events. The Members shall take the identity verification document specified by the organizers with them. If the identity is not verified, the Members may not be able to participate in the Events.
- The Members shall follow the instructions, participation guidance, manuals, etc., provided by the Foundation and the event organizers (hereinafter, the "Organizers").
- The Members shall participate in the Events on the date and time, in the activity block, and according to the activity content and other conditions that have been notified by the Organizers in advance. Any change to these conditions shall not be permitted.
- The Members should dress appropriately for the Events. Specifically for sporting events such as the Tokyo Marathon, the Members should wear clothes that are easy to move in, taking into consideration the temperature fluctuation, rain and other weather conditions (Follow any dress code specified by the Organizers of each event). Skirts, high heels, and sandals are prohibited. If the Members are deemed to be dressed inappropriately by the Organizers on the day of the Events, they shall be required to follow their instructions.
- If any items are supplied prior to the Events, the Members shall be sure to bring them and use them on the day of the Events.
- Items (such as clothing) will be distributed for the use of the Members who have entered and are participating in the Activities.
If the items are to be reused, the Members who have been supplied with the items can reuse them. The Members are prohibited from participating in activities while wearing clothing that has been borrowed or given to the Members by someone else.
Furthermore, the Members are prohibited from selling supplied items, listing them in auctions, or using them for promotional campaigns. If any violation is discovered, the Organizers shall notify the Members concerned to that effect.
- If a Member falls under any of the following, the Organizers reserve the right to refuse their participation in the Events:
- If the Member engages in any behavior that is deemed disruptive by the Organizers;
- If the Member is deemed by the Organizers unsuitable for volunteers due to being under the influence of alcohol, giving behavior or displaying an appearance that makes others uncomfortable;
- If the Member wears clothing or accessories intended to promote political or religious views or for advertising or promotional purposes;
- If the Member wears clothing or accessories that promote or advertise personal names, specific regions, or organizations that are not authorized by the Organizers; or that are intended for advertising or promotional purposes,
- If the Member is ineligible to participate in the Events because they have not been selected in a drawing, etc.
- If an information session is held prior to the Events, the Members must attend the session. The date, time, and location of the information session may be subject to change. The Members shall be sure to check the participation guidance.
- Except as necessary for the Activities or other events, the Members must not ask for personal information of the participants or other related parties of the Events. Furthermore, the Members shall not disclose or use any personal or confidential information obtained while participating in the Events.
- The Members shall refrain from soliciting participants or other related parties of the Events for anything unrelated to the Events (such as religious activities or multi-level marketing schemes).
- The Foundation shall assume no responsibility whatsoever for any disputes or troubles that may arise between participants of the Events. Such disputes or troubles shall be resolved upon consultation among participants.
- The Members shall not bring back any equipment or remaining distribution to be used for the Events operation.
- The Members shall not reproduce, copy, or distribute any information from various announcements, distributed manuals, etc. without permission. Furthermore, quotation or posting these contents on the internet, social media, etc. shall not be permitted.
- The Members shall check and arrange the transportation and routes, and necessary accommodations for attending information sessions, reception, and the Events by themselves and cover the expenses therefor. No compensation shall be paid for the Activities.
- The Organizers shall take out a lump-sum insurance plan for all Members participating in the Activities as insured (the Members will pay no insurance premium). Consolation payment may be paid for injuries or illnesses sustained during the Activities.
Below is a breakdown of consolation payment.
Death: 5 million yen, Hospitalization: 4,000 yen per day, Outpatient: 2,000 yen per day
* A doctor's certificate (original) shall be required to receive consolation payment. Please note that the medical expenses (treatment costs) will not be covered by the insurance.
* When those residing outside of Japan receive treatment or are hospitalized in a hospital in Japan, medical expenses are extremely high, and in most cases, the consolation payment from competition cannot cover these medical costs. It is strongly recommended to purchase personal travel insurance and medical insurance that provides adequate coverage for injuries and illnesses during overseas travel.
Participants in online events shall not be covered by the insurance stipulated in this paragraph.
- If the Members feel unwell during the Activities, they should not push themselves and return home or seek medical attention from a crisis management perspective.
- The Members shall understand that their likeness may appear in videos, photographs, etc., taken during information sessions, reception, and the Events, and agree in advance that videos, photographs, etc., containing their likeness may be published on television, in newspapers, magazines, on the internet, on posters, brochures, etc.
- The Foundation shall not be held liable for any damages incurred by the Members as a result of participating in events organized by organizers other than the Foundation.
- The Members shall not use volunteer activities for the public relations purposes of the organization (company, group, school) to which they belong. *Excluding official partners
However, the Member may use volunteer activities for public relations purposes only if a permission is obtained from the Foundation following an application for property approval in accordance with the regulations of the Foundation. (Applicable only if participating as a team in the Tokyo Marathon or Tokyo Legacy Half Marathon.)
- [When participating in an online event]

In addition to the above, the following provisions also apply.
- If participating in an online event, the Members shall refrain from participating from a public space in order to protect the privacy and confidentiality of participants and those around them.
- Depending on the internet connection and computer performance used by participants, the streamed video may be delayed or interrupted, preventing normal viewing. Participants should perform a connection test of the streaming platform in advance.
- Reproduction, screening, public transmission, exhibition, distribution, transfer, lending, adaptation, translation, secondary use, etc. of streamed video (including, but not limited to, recording, capturing still images, etc., hereinafter the same) shall be prohibited regardless of the purpose.
- Reproducing, screening, publicly transmitting, exhibiting, distributing, transferring, lending, adapting, translating, or otherwise making secondary use of the streamed video without the Organizers' permission constitutes an infringement of the rights holder's copyright and other rights, and may result in procedures such as termination of VOLUNTAINER membership.
- If participating from a tablet or smartphone, it may need to install an online tool application. In that case, be sure to use the latest version.
Even if any malfunction occurs to device of the Members or personal information is leaked accordingly, the Foundation cannot be held responsible for such problems.
